Who We Are

This Privacy Policy explains how MS Realty Team (#SpousesSellingHouses), a team of licensed Texas real estate sales agents brokered by Realty of America (“MS Realty Team,” “we,” “us,” or “our”), collects, uses, and shares information about you. It applies to msrealtyteam.com, app.msrealtyteam.com, terms.msrealtyteam.com, and their subdomains (the “Website”), and to our social media pages and ads, lead forms, calls, text messages, emails, AI virtual assistant, calculators, and other services (together, the “Services”).

By using the Services, you agree to this Privacy Policy and our Terms of Service. If you sign a separate written agreement with us or our Brokerage, such as a buyer representation or listing agreement, that agreement also governs how we handle information for that transaction.

Information We Collect

Information you give us. When you fill out a form, message us, schedule a call, or work with us, you may share:

• Contact details, such as your name, phone number, email address, mailing address, and preferred language.
• Home goals, such as whether you want to buy, sell, or lease, your timeline, price range, preferred areas, property details, and current home situation.
• Information you choose to share about financing, such as a pre-approval, budget, veteran status for VA loan eligibility, or down payment plans.
• Messages, comments, reviews, and anything else you send us.
• Appointment details when you book time with us through our scheduling page.

Information from social media and ads. When you submit a lead form or message us on Facebook, Instagram, TikTok, or another platform, that platform shares your submission with us. This usually includes your name, phone, email, and your answers to the form’s questions. The platform may also tell us which ad or campaign you responded to.

Information from calls, texts, and email. When you talk or message with us or our AI virtual assistant, we collect the content of those conversations. This may include call recordings, transcripts, summaries, text and email history, and details like the date, time, and length of a call.

Information collected automatically. When you use the Website or open our emails, we and our service providers may collect device and usage information. This can include your IP address, browser type, device type, pages viewed, links clicked, referring site, approximate location based on IP address, and whether an email was opened.

Information from other sources. We may receive information about you from referral partners, lenders you ask us to work with, other real estate professionals, MLS systems, public records (such as property and tax records), and the parties to your transaction, such as title and escrow companies.

How We Use Information

We use information to:

• Respond to your questions and contact you about the real estate services you asked about.
• Schedule appointments, showings, and consultations.
• Send you property searches, market updates, homeowner resources, and other information you asked for or agreed to receive.
• Represent you in buying, selling, or leasing a property, and coordinate with lenders, title, escrow, inspectors, and other parties as needed.
• Run and improve our Website, app, calculators, AI assistant, and follow-up process.
• Measure how our ads and content perform, and show relevant ads on social media and other sites.
• Keep records required by law, our Brokerage, or the Texas Real Estate Commission.
• Protect against fraud, spam, and misuse, and enforce our Terms of Service.
• Comply with law and respond to lawful requests.

AI Virtual Assistant and Call Recordings

We use an AI-powered virtual assistant to respond quickly in English and Spanish. It may call you, answer your calls, send texts and emails, ask about your home goals, and send you a link to schedule time with a licensed agent. It uses an AI-generated voice and is not a person. You may ask to speak with a licensed agent at any time.

Calls with the assistant or our team may be recorded, transcribed, and summarized. We use recordings and transcripts to follow up with you personally, keep accurate notes, train and improve the assistant, and maintain quality. Our AI and phone service providers process this information on our behalf under their own security obligations. If you do not want to be recorded, you may end the call and ask us to contact you another way.

Text Messaging

If you agree to receive text messages, we may text you about your inquiry, appointments, properties, and our services. Message frequency varies. Message and data rates may apply. Reply STOP, UNSUBSCRIBE, CANCEL, END, or QUIT (or ALTO / PARAR in Spanish) to opt out. Reply HELP for help.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. This excludes service providers that help us send messages and run our business, who may only use it to provide those services to us.

How We Share Information

We share information only as described here:

• Our Brokerage. Realty of America supervises our work and keeps transaction records, as Texas law requires.
• Service providers. Companies that help us run our business, such as CRM, phone, texting, email, AI assistant, scheduling, website hosting, analytics, and document providers. They may use your information only to provide services to us.
• Transaction parties. When you are buying, selling, or leasing, we share what is needed with the other parties and professionals involved, such as other agents, lenders, title and escrow companies, inspectors, appraisers, and attorneys.
• Lenders and service providers you ask for. We share your information with a mortgage lender or other provider only if you ask us to or indicate on a form that you want those services.
• Referral partners. If you need help in another area or state, such as Florida, we may refer you to a licensed agent there, with your permission.
• Advertising platforms. Platforms like Meta (Facebook and Instagram) and TikTok may receive limited information, such as the fact that you visited our Website or submitted a form, to measure and improve our ads. See “Cookies, Pixels, and Ads” below.
• Legal and safety reasons. To comply with law, legal process, or a government request; to enforce our Terms; or to protect the rights, property, or safety of you, us, or others.
• Business changes. If our team changes brokerages or our business is transferred, client records may move with it, subject to this policy and applicable law.

We Do Not Sell Your Information

We do not sell your personal information, and we do not share it with third parties for their own marketing. We do not sell or rent lead lists.

Cookies, Pixels, and Ads

Our Website and app may use cookies, local storage, and similar tools to keep them working, remember your preferences, and understand how they are used. We may also use advertising and analytics tools, such as the Meta Pixel, TikTok Pixel, or Google Analytics, to measure our ads and show relevant ads to people who visited our site.

You can block or delete cookies in your browser settings, though some features may not work. You can manage ad preferences in your Facebook, Instagram, TikTok, and Google account settings. Our Website does not currently respond to browser “Do Not Track” signals.

How Long We Keep Information

We keep information for as long as we need it to serve you, follow up on your inquiry, and meet legal, brokerage, and recordkeeping requirements. Texas rules require brokerages to keep transaction records for a set period. When we no longer need information, we delete it or make it de-identified, unless the law requires us to keep it.

Security

We use reasonable administrative, technical, and physical safeguards to protect your information, and we limit access to people who need it. No method of storage or transmission is completely secure, so we cannot guarantee absolute security.

Please never send Social Security numbers, bank account numbers, or wire instructions by text, email, or social media message. We will never ask you to wire money based only on an email or text. Always confirm wire instructions by calling your title company at a phone number you know is real.

Your Choices and Rights

• Marketing texts: reply STOP (or ALTO) to any text.
• Marketing emails: use the unsubscribe link in any marketing email.
• Calls: tell the assistant or any team member that you do not want more calls, or email us.
• Access, correction, and deletion: email info@msrealtyteam.com to ask what information we have about you, to correct it, or to delete it. We may need to verify your identity, and we may keep information the law or our Brokerage requires us to keep.

Depending on where you live, you may have additional rights under state privacy laws, such as the right to appeal a decision about your request. To appeal, reply to our decision or email us with “Privacy Appeal” in the subject line. We will not discriminate against you for using any of your privacy rights.

Children

Our Services are for adults 18 and older. We do not knowingly collect personal information from children under 13 (or from anyone under 18 through our lead forms). If you believe a child has given us information, contact us and we will delete it.

Other Websites and Platforms

Our Services link to websites and tools we do not control, such as social media platforms, scheduling tools, lender applications, and government sites. Their own privacy policies govern how they handle your information. Please review them before sharing information there.

Changes to This Policy

We may update this Privacy Policy from time to time. The “Last updated” date at the top shows when it last changed. If we make material changes, we will post a notice on the Website or notify you by another appropriate means. Continued use of the Services after a change means you accept the updated policy.
