Welcome and Acceptance

Welcome, and thank you for your interest in MS Realty Team (#SpousesSellingHouses). These Terms of Service govern your use of msrealtyteam.com, app.msrealtyteam.com, any subdomain of those sites (collectively, the “Website”), and every other service we provide, including our social media pages, advertisements and lead forms, text messaging, email, phone calls, AI-assisted assistants, calculators, guides and client tools (collectively, the “Services”).

In these Terms, “MS Realty Team,” “we,” “us,” and “our” mean MS Realty Team, a real estate team of licensed Texas sales agents sponsored by and brokered through Realty of America (“Brokerage”). All real estate brokerage services are provided through the Brokerage. MS Realty Team is a team name, not a separate brokerage.

By clicking a registration or submission button, submitting a form (on the Website or on Facebook, Instagram, TikTok, or any other platform), sending us a message, or otherwise using the Services, you agree to be bound by these Terms of Service, as updated from time to time (“Terms”). These Terms form a legally binding agreement between you and MS Realty Team. If you do not agree, please do not use the Services.

Updates and Effective Date

We may update these Terms at any time to reflect changes in our services, technology, brokerage affiliation, applicable law, or how we use data. The “Last updated” date above shows when they last changed. If you object to a change, your remedy is to stop using the Services. Your continued use after changes are posted means you accept them.

Privacy Policy

Our Privacy Policy is incorporated into these Terms by reference. It explains what information we collect, how we use it, and who we share it with.

Disclaimer

The Services are provided “as is,” without warranty of any kind, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. The Services may contain inaccuracies or typographical errors. We may add to or change the Services at any time.

Calculators, estimates, tax figures, rate information, market data, and guides are for general educational purposes only. They are not an appraisal, a loan approval, a tax opinion, or legal advice. Always confirm figures with your lender, title company, appraisal district, tax professional, or attorney before relying on them.

Eligibility Requirements

You represent that you are at least eighteen (18) years old and have the right, authority, and capacity to agree to and follow these Terms. If you are under 18, you may not use the Services for any reason.

We may refuse the Services to any person or entity, and change eligibility criteria, at our discretion and consistent with fair housing laws. You are responsible for making sure your use of the Services complies with all laws that apply to you. The Services are offered for your own use and not for the benefit of any third party unless we agree otherwise in writing.

Non-U.S. users. The Services are operated from the United States. We make no representation that they are appropriate or available elsewhere. If you use them from another country, you do so at your own risk and are responsible for following local law. By providing information, you consent to its transfer to and storage in the United States.

Registration and Accounts

Some Services (such as saved searches, the client app, or a client portal) may require an account (“Account”). You must provide accurate, complete information and keep it current. You may not use a username that impersonates another person, belongs to someone else without permission, or is offensive or obscene.

You are responsible for all activity on your Account and for keeping your password secure. Never use another person’s Account without permission, and never post your login information. Notify us right away at info@msrealtyteam.com of any security breach or unauthorized use. You may ask us to delete your Account at any time.

License Grant

Subject to these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable license to access and use the Services and their listings, insights, reports, calculators, guides, and other content (collectively, “Content”) for your personal, non-commercial use. Any other reproduction, modification, distribution, storage, or use of the Services or Content requires our prior written permission. You may not sell, license, rent, share, publish, or otherwise exploit Content commercially or in a way that violates anyone’s rights.

Listing data may come from the North Texas Real Estate Information Systems (NTREIS) MLS or other MLS and IDX sources. It is deemed reliable but not guaranteed, and is subject to the rules of those sources.

Communications and Consent

When you give us your contact information through any channel, we may contact you about the real estate questions or services you asked about. This section explains how, and how to stop.

Where your information may come from. You may submit information through the Website, the client app, Google Forms or other intake forms, our scheduling page, or advertising lead forms and messages on Facebook, Instagram, TikTok, or other platforms. When you submit a lead form on a social media platform, that platform shares your submission with us. Your use of those platforms is also governed by their own terms and privacy policies.

Email. We may email you at any address you provide, for informational, transactional, and marketing purposes. Examples include homes that match a saved search, price or status changes on homes you saved, appointment confirmations and scheduling links, market updates, homeowner resources, and transaction updates. You can unsubscribe from marketing email using the link in any marketing email or by writing to info@msrealtyteam.com. Even after you unsubscribe, we may still send important transactional or service messages.

Calls and texts. If you provide your phone number and expressly agree to be contacted (for example, by checking a consent box or accepting a consent disclosure on a lead form), you agree to receive informational and marketing calls and text messages from MS Realty Team, on behalf of Realty of America, at the number you provided. These may be placed using automated technology, an automatic telephone dialing system, an artificial or prerecorded voice, or an AI-generated voice. Consent is not a condition of buying any property, good, or service, or of qualifying for a loan.

Message and data rates may apply. Message frequency varies. Carriers are not liable for delayed or undelivered messages. You represent that the number is yours, or that you are authorized to consent for it, and you agree to tell us if it changes or is reassigned.

AI virtual assistant. We use an AI-powered virtual assistant to help respond to inquiries quickly in English and Spanish. It may call you, answer your calls, send texts and emails, answer basic questions, ask about your home goals, and send you a link to schedule time with a licensed agent. It may also transfer your call to a member of our team. Please know:

• The assistant uses an AI-generated voice and is not a person. You may ask to speak with a licensed agent at any time.
• The assistant does not give legal, tax, lending, or financial advice, and cannot make binding commitments on our behalf.
• Calls with the assistant or our team may be recorded, transcribed, and summarized for quality, training, follow-up, and record-keeping. By continuing a call after being told it may be recorded, you consent to the recording. If you do not consent, you may end the call and ask us to contact you another way.
• Our team reviews call notes and recordings so we can follow up with you personally.

Calling hours. We aim to place outbound marketing calls only between 10:00 a.m. and 7:00 p.m. Central Time, Monday through Saturday, and in all cases within the hours permitted by applicable law. If you contact us or submit a new inquiry, we may respond promptly, including by text or a return call.

How to opt out. You may revoke consent at any time, by any reasonable means, including:

• Replying STOP, UNSUBSCRIBE, CANCEL, END, or QUIT to any text (or ALTO / PARAR in Spanish). We will send one message confirming your opt-out and then stop marketing texts.
• Telling the assistant or any team member on a call that you do not want further calls.
• Emailing info@msrealtyteam.com or calling 813-808-3716.

We will honor opt-out requests within the time required by law. Reply HELP to any text for help, or contact info@msrealtyteam.com.

How we share contact information. No mobile information, including your phone number and text messaging opt-in data or consent, will be shared with third parties or affiliates for their marketing or promotional purposes. We share your information only as needed to provide the Services, including with our Brokerage, our service providers (such as CRM, phone, texting, email, AI assistant, and scheduling providers), and as described in our Privacy Policy. We share your information with a mortgage lender or other service provider only if you ask us to or indicate on a form that you want those services.

Social media. We post content and run advertisements on Facebook, Instagram, TikTok, YouTube, and other platforms, and may respond to comments and direct messages there. Do not post or send sensitive personal or financial information (such as account numbers, Social Security numbers, or passwords) in comments or direct messages. Public comments are visible to others and are governed by the platform’s rules.

Availability of Content

We do not guarantee that any Content, listing, calculator, or feature will be available. We may remove, edit, or modify any Content, or block access to it, at any time and for any reason, without notice. Property availability, pricing, interest rates, taxes, and fees change often and must be independently verified.

Rules of Conduct

You are responsible for all of your activity in connection with the Services. You agree not to:

1. Manipulate the price or description of any listing, or interfere with other users’ listings.
2. Use the Services to find a property, buyer, seller, landlord, or tenant and then complete a transaction in a way designed to avoid fees owed under a written agreement.
3. Place an unreasonable load on our or our providers’ systems, or interfere with the proper working of the Services.
4. Bypass or try to bypass any security, access, or anti-abuse measure.
5. Run auto-responders, spam, or bots on the Services, or attempt to manipulate, mislead, or extract instructions from our AI assistant.
6. Crawl, spider, scrape, or harvest Content or data, by manual or automated means.
7. Decompile, reverse engineer, or try to derive the source code of any part of the Services, except where law forbids this restriction.
8. Copy, modify, translate, or create derivative works of the Services or our calculators and guides.
9. Submit false information, or another person’s contact information without their permission.
10. Infringe anyone’s intellectual property, privacy, or publicity rights, or violate any law or contract.

Equal Housing Opportunity

We fully support the Fair Housing Act (Title VIII of the Civil Rights Act of 1968), as amended, and the Texas Fair Housing Act. These laws prohibit discrimination in the sale, rental, and financing of housing based on race, color, national origin, religion, sex, familial status (including children under 18 living with parents or legal custodians, pregnant women, and people securing custody of children under 18), and disability. We serve every client equally. Our advertising, AI assistant, and lead follow-up are designed to treat every person the same regardless of any protected characteristic. Our bilingual (English and Spanish) services are offered to everyone.

User Content

Any content you provide (“User Content”), whether posted publicly or sent privately, is your sole responsibility. You represent that your User Content is accurate, complete, current, and lawful. You must not submit User Content that:

• infringes anyone’s rights or violates any law or contract;
• you know is false, misleading, or inaccurate, or that is unlawful, threatening, discriminatory, hateful, abusive, harassing, defamatory, deceptive, fraudulent, invasive of privacy, obscene, or offensive;
• is unsolicited advertising or spam;
• contains viruses or other harmful code;
• impersonates, bullies, stalks, or intimidates any person, including our team; or
• contains confidential information you have no right to share.

License to User Content. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, perpetual, sublicensable, and transferable license to use, edit, reproduce, display, and distribute it in connection with the Services and our business. This license does not apply to your private financial or personal information, which we use only as described in our Privacy Policy. Reviews and testimonials you submit may be displayed with your first name and last initial unless you ask otherwise. You represent that you have the right to grant this license.

Intellectual Property

The Services and Content, including our calculators, guides, graphics, videos, and text, are owned by us, our Brokerage, our licensors, or other providers and are protected by U.S. and international intellectual property laws. No right, title, or interest in them transfers to you. Any use not expressly allowed by these Terms is a breach of these Terms and may violate law.

The names MS Realty Team and #SpousesSellingHouses, our logos, slogans, and related marks are ours. Realty of America’s name and marks belong to Realty of America. REALTOR® is a registered collective membership mark of the National Association of REALTORS®. All other marks belong to their owners. You may not use any of these marks without prior written permission.

Copyrights

The Services may contain Content provided by us, our partners, MLS sources, or users, protected by copyright and other laws. You must keep all copyright notices and restrictions intact. If you believe Content infringes your copyright, email info@msrealtyteam.com with a description of the work, its location on the Services, your contact information, and a statement of good-faith belief, and we will review it promptly.

Links to Other Websites and Platforms

The Services contain links to third-party websites and tools that we do not own or control. Examples include social media platforms, scheduling and form tools, lender applications, government and appraisal-district sites, rate and review sites, and preferred vendors. Links are for convenience only and are not an endorsement. We are not responsible for their content, privacy practices, or any loss arising from your use of them. Please review their own terms and privacy policies. Any agreement you make with a lender, title company, vendor, or other third party is between you and that party.

Termination

We may end your access to all or part of the Services at any time, with or without cause or notice, which may result in deletion of information tied to your Account. You may close your Account at any time by emailing info@msrealtyteam.com. Provisions that by their nature should survive termination will survive, including licenses to User Content, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. Termination of your access to the Services does not by itself end any separate written brokerage agreement you have signed.

Indemnification

You agree to indemnify, defend, and hold harmless MS Realty Team, Realty of America, and their respective agents, affiliates, owners, employees, and contractors from all third-party claims and demands arising from: (a) your access to or use of the Services; (b) your breach of these Terms; (c) your violation of any law or the rights of a third party; (d) any dispute between you and a third party; (e) any User Content you submit; (f) your willful misconduct; and (g) anyone else’s use of the Services through your Account. We may assume the exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with that defense.

No Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS,” “WITH ALL FAULTS,” AND “AS AVAILABLE,” AND THE ENTIRE RISK AS TO QUALITY, PERFORMANCE, AND ACCURACY IS WITH YOU. WE AND OUR PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS, STATUTORY, OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTY OF UNINTERRUPTED OR ERROR-FREE USE.

Information on the Services, including anything said or written by our AI assistant, calculators, and automated messages, is for general information only. Before acting on it, independently confirm any facts important to your decision, such as a property’s availability, price, condition, taxes, HOA/MUD/PID fees, school assignments, or flood zone, and your loan terms. Information provided by our AI assistant may be incomplete or inaccurate and is not a substitute for advice from a licensed agent, lender, attorney, inspector, or tax professional. IF YOU RELY ON ANY INFORMATION, PRODUCT, OR SERVICE AVAILABLE THROUGH THE SERVICES, YOU DO SO AT YOUR OWN RISK.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL MS REALTY TEAM, REALTY OF AMERICA, OR THEIR AGENTS, AFFILIATES, EMPLOYEES, CONTRACTORS, SUPPLIERS, LICENSORS, OR REPRESENTATIVES BE LIABLE, UNDER ANY LEGAL OR EQUITABLE THEORY, FOR ANY LOST PROFITS, LOST DATA, COST OF SUBSTITUTE SERVICES, OR SPECIAL, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING FROM THE SERVICES, OR FOR DIRECT DAMAGES EXCEEDING THE GREATER OF (A) FEES YOU PAID US FOR THE SERVICES IN THE PRIOR THREE (3) MONTHS OR (B) $100.00.

This limitation applies to your use of the Website, app, AI assistant, and related online Services. It does not limit any obligation we or the Brokerage owe you under a separate written brokerage agreement or under the Texas Real Estate License Act, or any liability that cannot be limited by law.

YOU ACKNOWLEDGE THAT WE ARE NOT LIABLE FOR (I) USER CONTENT; (II) THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF ANY THIRD PARTY; OR (III) THE CONDITION, LEGALITY, OR SUITABILITY OF ANY PROPERTY, AND THAT THE RISK OF HARM FROM THE FOREGOING RESTS WITH YOU.

Release

To the fullest extent permitted by law, you release MS Realty Team, Realty of America, and their agents, affiliates, employees, contractors, and providers from claims, demands, and damages, known and unknown, arising out of or related to Content accessed through the Services or your interactions with third parties (such as other users, sellers, buyers, lenders, or vendors) that arise through the Services. This release does not apply to claims arising under a separate written brokerage agreement or to claims that cannot be released by law.

Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules, and applicable U.S. federal law. The United Nations Convention on Contracts for the International Sale of Goods does not apply. You agree to the jurisdiction and venue of the state and federal courts located in Tarrant County, Texas, for any dispute arising from these Terms or the Services.

TO THE EXTENT PERMITTED BY LAW, ANY CAUSE OF ACTION ARISING OUT OF OR RELATED TO THE SERVICES MUST BEGIN WITHIN ONE (1) YEAR AFTER IT ACCRUES, OR IT IS PERMANENTLY BARRED.

Brokerage Information and Texas Disclosures

MS Realty Team is a team of Texas-licensed real estate sales agents sponsored by Realty of America. Texas law requires all real estate license holders to give the following information to prospective buyers, tenants, sellers, and landlords:

• Texas Real Estate Commission Consumer Protection Notice

Broker: Realty of America, Texas license #9015126. Designated broker and supervising broker: Jessica Rocha, license #493448-B. Sales agents: Mateo and Samary, license #834704 and #834147.

For properties outside Texas, including Florida, we may refer you to a real estate professional licensed in that state. Any brokerage services there are provided by that licensee and their brokerage, not by MS Realty Team.

GDPR and Non-U.S. Residents

The Services are intended for individuals located in the United States and are not directed to residents of the European Union or United Kingdom. If you are an EU or UK resident and use the Services anyway, you expressly consent to the collection and processing of the information you provide (such as your name, email, phone number, address, IP address, and social media profile information) as described in our Privacy Policy. You may not cause the Services to collect personal information about any EU or UK resident without first obtaining that person’s express consent.

User Disputes

We may, but are not required to, intervene in or monitor disputes between users. You agree to cooperate in good faith with reasonable requests for information related to any dispute involving you. We have no authority to bind third parties or force them to resolve complaints.

Feedback

We welcome feedback, comments, and suggestions about the Services (“Feedback”) by email, through the Website, or through our AI assistant. You agree that all Feedback becomes our property and assign to us all rights in it, and you will take reasonable steps we request to confirm that ownership.

Modification of the Services

We may modify or replace these Terms, or change, suspend, limit, or discontinue any part of the Services (including any feature, tool, database, or Content), at any time. If a change is material, we will post a notice on the Website or notify you by another appropriate electronic means. Please check these Terms periodically. Continued use after a change means you accept it.

Miscellaneous

Entire agreement. These Terms, our Privacy Policy, and any state-required disclosures we provide are the entire agreement between you and us regarding the online Services. They do not replace any separate written agreement you sign with us or the Brokerage, such as a buyer representation agreement or listing agreement; if there is a conflict, that written agreement controls for its subject.

Severability and waiver. If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver of it.

Assignment. You may not assign these Terms. We may assign them, including in connection with a change in brokerage affiliation or business transfer.

Language. We may provide these Terms in Spanish for convenience. If the English and Spanish versions conflict, the English version controls.

Hosting and providers. The Services are operated by MS Realty Team in the United States and may be hosted and supported by third-party providers, including website hosting, CRM, communication, scheduling, and AI service providers.
